Acceptance

By accessing or using the website at pashalabs.dev, a visitor agrees to be bound by these Terms of Service. A visitor who does not accept these Terms should not use the Site.

Scope

These Terms govern use of the Site only. They do not govern the performance of professional services, which is addressed in Section 5.

The Site

The Site is an informational publication of Pasha Labs LLC, a limited liability company organised under the laws of the State of Texas. It describes categories of services and publishes an address for correspondence. It provides no user account, no transaction facility, and no interactive service.

No Offer

Nothing on the Site constitutes an offer capable of acceptance, a quotation, a proposal, or a representation as to price, availability, timescale, or outcome. Descriptions of services are general summaries provided for information and are not specifications.

Professional Engagements

No professional relationship arises from use of the Site or from correspondence sent through it. Any engagement of Pasha Labs LLC arises only upon execution of a written agreement between the parties addressing scope of work, fees, timescales, ownership of deliverables, confidentiality, and termination.

In the event of any conflict between these Terms and such an agreement, that agreement prevails in respect of the engagement to which it relates.

Permitted Use

A visitor may access the Site, read its contents, link to it, and quote from it with attribution, in each case for lawful purposes.

Prohibited Use

A visitor shall not:

• interfere with or attempt to impair the operation, integrity, or security of the Site;
• obtain or attempt to obtain unauthorised access to any system or network connected to the Site;
• employ automated means to access the Site in a manner that imposes an unreasonable burden on its infrastructure;

Intellectual Property

The text, layout, design, and marks appearing on the Site are the property of Pasha Labs LLC or are used under licence. Nothing in these Terms transfers any right, title, or interest in that material. The typefaces employed by the Site are licensed from their respective proprietors.

Third-Party Links

Where the Site refers to a third-party service or resource, that reference is made for convenience only. Pasha Labs LLC does not control such resources, does not endorse them, and accepts no responsibility for their content, availability, or practices.

Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Pasha Labs LLC disclaims all warranties, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

Nothing on the Site constitutes legal, financial, tax, or other professional advice, and no person should act or refrain from acting in reliance upon it.

Limitation of Liability

To the fullest extent permitted by law, Pasha Labs LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of profit, revenue, data, goodwill, or business opportunity, arising out of or in connection with use of the Site, whether founded in contract, tort, statute, or otherwise, and whether or not the possibility of such loss was advised.

Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited.

Indemnity

A visitor shall indemnify and hold harmless Pasha Labs LLC against any claim, liability, loss, or expense, including reasonable legal fees, arising from that visitor's breach of these Terms or unlawful use of the Site.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws provisions. The parties submit to the exclusive jurisdiction of the state and federal courts situated in the State of Texas.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

No Waiver

A failure or delay in enforcing any provision of these Terms shall not constitute a waiver of that provision or of any other.

Entire Agreement

These Terms constitute the entire agreement between the visitor and Pasha Labs LLC in respect of use of the Site, and supersede any prior understanding relating to that subject matter.

Amendment

These Terms may be amended from time to time. The effective date shown at the head of this page indicates when the current version took effect. Continued use of the Site following amendment constitutes acceptance of the Terms then in force.
